Terms and Conditions

These Terms and Conditions, together with any Membership Form, set out the agreement (this Agreement) under which you or, where applicable, the person for whom you are the parent or guardian (the Member, you, your) will obtain services, including the Activities, from Golf Athletics ABN 75 642 967 664 (Golf Athletics, we, us, our).

We may change these Terms and Conditions at any time by updating the Terms and Conditions page on our website, and your ordering of Activities following such an update will represent an agreement by you to be bound by the Terms and Conditions as amended. Changes to these Terms and Conditions will only apply to Membership Forms entered into after the change occurs. However, we will only increase your Fees in accordance with clause 9.3 below.

1. Membership Form, This Agreement

(a) These Terms and Conditions will apply to all the Member's dealings with Golf Athletics, including being incorporated in all agreements or quotations under which Golf Athletics is to provide services to the Member (each a Membership Form) together with any additional terms included in such a Membership Form (provided such additional terms are recorded in writing).

(b) The Member will be taken to have accepted this Agreement if the Member accepts a Membership Form, or if the Member orders, accepts, or pays for any Activities provided by Golf Athletics after receiving or becoming aware of this Agreement or these Terms and Conditions.

(c) 'Children' memberships are attached to a non-playing parent or guardian account. The parent or guardian acknowledges their responsibility for supervision as outlined in clause 4.1(iv).

2. Term

(a) Minimum Term Memberships: The minimum term for each membership is specified in the respective membership plan. The term begins on the Commencement Date and continues for the full duration of the minimum term.

(b) Automatic Rollover: At the end of the minimum term, memberships will automatically roll over onto a week-to-week payment structure, and the minimum notification period for cancellations, as stipulated in these Terms, will apply.

(c) Pay-Per-Use Memberships: Pay-per-use memberships do not have a minimum term. Members will be charged each time they use Golf Athletics facilities or coaching services.

3. Cooling Off Period

(a) A cooling-off period of 3 days applies to all classes, short courses, or events. No refunds will be issued for cancellations made 7 days prior to commencement of any classes, short courses, or events.

4. Participant's Obligations

4.1. Documentation and Information

The Member must: (a) Provide Golf Athletics with all documentation, information, and assistance reasonably required for Golf Athletics to deliver services and activities.

(b) Participate in any briefings or introductions as notified by Golf Athletics before engaging in any Activities.

(c) Ensure that any individuals under the age of 18 for whom the Member is a parent or guardian comply with these Terms. The Member agrees to these terms on behalf of such individuals.

4.4. Instructions and Safety

The Member warrants that they: (a) Will undertake an instructional consultation with Golf Athletics personnel prior to or while using the facility or participating in Activities.

(b) Will comply with any safety guidelines, instructions, and rules provided by Golf Athletics personnel.

(c) Will abide by the Club Code outlined in clause 12.

(d) Will cease participating in any Activities and notify Golf Athletics personnel if they have concerns about their health, safety, or if they feel unwell, dizzy, faint, or experience any unusual pain during the Activities.

(e) Will be responsible for their own safety and for ensuring the safety of any person under the age of 18 for whom they have taken responsibility. As members are responsible for their own safety and safety of any one they bring into any Golf Athletics facility, any personal damages and/or injuries are the sole responsibility of the member.

4.5. Health and Condition of the Participant

The Member warrants that they: (a) Are not pregnant and do not have any health conditions that might increase their risk of injury while participating in Activities.

(b) Will notify Golf Athletics immediately if they develop any such health conditions (Condition).

(c) Understand that if they have a Condition, Golf Athletics may refuse them participation in some or all Activities.

(d) Acknowledge that Activities, even without an accident, may involve risk to health.

(e) Will not participate in Activities while under the influence of drugs, alcohol, or illicit substances.

(f) Will not participate in Activities if they are ill, injured, or feeling unwell.

(g) Will warm up appropriately before participating in any Activities.

4.6. Possessions

(a) The Member is responsible for their own possessions while at the Golf Athletics facility. Golf Athletics is not liable for any lost or stolen possessions.

(b) If the Member uses storage facilities at Golf Athletics, they do so at their own risk, and Golf Athletics will not be liable for any loss or theft of possessions stored there.

4.7. Carpark

The Member understands and agrees that the use of any car parking facilities is unsupervised and at their own risk. Golf Athletics is only liable for any loss or damage suffered by the Member to the extent that Golf Athletics’ negligence contributed to such loss or damage. The Member agrees to use allocated parking that is marked, where they are unsure of parking spots, they will refrain from using and clarify with Golf Athletics staff.

4.8. Guests

Member’s are strictly forbidden to bring any guests to Golf Athletics. Doing so will violate our membership’s terms and conditions and will incur a security fee and additional charges. See security.

Guests are welcome to attend Golf Athletics on open days and public events organised by Golf Athletics. 

4.9. Access Fob (Bluetooth App Access)

(a) All new members must purchase a door access Fob or use the digital Bluetooth app to gain secure entry to the Golf Athletics facility.

(b) Members must not share their access card or Bluetooth app access with anyone else, nor use it to grant entry to other individuals, including other members.

(c) The replacement cost for a lost or damaged access card is $25.

(d) Members must not open the door for any other person(s) as this will incur a security fee. Members must scan in to enter the facility, failure to do so will also incur a security fee. 

(e) Members must have their account without owings to use their access Fob or digital Bluetooth App. Access without having their accounts paid in full, will incur a security fee.

(f) Entry is only valid via the main entry door. Fire exits must not be used to enter the facility at any time.

(g) Parents must check all individual children into Golf Athletics for access to practice and usage outside of class times.

5. Fixed-Term Membership Rules

(a) Duration: Fixed-term memberships are available for a specified period (e.g., 12 months). Members have unlimited access to the facility during this period, subject to availability and general rules.

(b) Membership Pause: Fixed-term members may pause their membership for up to 4 weeks per calendar year with written notice. Pauses beyond this limit are not permitted unless approved by Golf Athletics.

(c) Renewal: Fixed-term memberships automatically roll over into week to week membership and are considered an open-ended membership.

(d) Early Termination: Members may terminate their fixed-term membership early by paying a termination fee equal to 1/3 of the total minimum term cost for membership that is for 6 months or longer only. Access will cease upon the agreed termination date and after the termination fee has been processed.

(e) Cancellation and Refunds: Fixed-term memberships are non-refundable. No refunds or partial refunds will be provided for unused time, except under the early termination clause above.

6. Pay-Per-Use Membership Rules

(a) Single Entry Payment: Pay-per-use members are charged for one per visit, which includes a booking allocation of 1.5 hours. After this period, additional time is available based on facility availability.

(b) Guest Policy: No guests are allowed, and any violations will result in a $350 fee automatically charged and then followed with a review for any further charges for damages/violations.

(c) Off-Peak Days: Pay-per-use members are granted access only on off-peak days (This is listed on our website). Off-peak days are subject to change at Golf Athletics’ discretion.

(d) No Refund Policy: All payments for pay-per-use entries are final and non-refundable.

(e) Post Private Class: Members who do not have a valid access membership, may not use the facility for practice after a private class. A valid single entry payment or an access membership must be purchased and activated prior to using our facilities. Security fees and access fees will be charged to your account if usage extends the private class.

(f) Security Monitoring: is active and monitored by an external company. This means that charges will be made if there is unauthorised use.

7. Bookings and Time Allocation

(a) Members are entitled to a 1.5-hour bookings per day. Additional time is available based on facility availability.

(b) Booking rules, including time allocations, may be changed at Golf Athletics' discretion. Any changes will be communicated via email.

(c) Members must vacate their space when asked to by a member who has booked to use any facility resources/spaces.

(d) Bookings that do not get checked in, will receive two warnings and then any subsequent missed bookings to any resources/spaces will incur a $69 charge for every missed session.

(e) Members can cancel their booking 60 minutes prior to the commencement of their booking. 

8. Fees and Payments

(a) Membership fees must be paid in full as outlined in the Membership Form. All payments are final, and no refunds will be provided.

(b) For security fees, a $350 fee will be automatically charged and then reviewed by Golf Athletics for any further damages and/or access charges or membership terminations. 

(c) Fee increases will be communicated 30 days in advance, and transaction fees may apply to payments made through direct debit services like GymMaster.

9. Liability and Indemnity

Golf Athletics is not responsible for loss or damage to personal belongings. Full liability and indemnity terms can be found in the original terms and conditions.

10. Cancellation by Member

(a) For fixed-term memberships, members must provide 30 days' written notice of cancellation. Early termination requires payment of 1/3 of the total minimum term fee, after which access will cease.

(b) Cancellations must be made in writing using our cancellation form on our website. Instruction to 

11. Amendments and Communication

Golf Athletics reserves the right to amend these Terms at any time. Members will be notified of any significant changes via email.

12. Club Code

The Member must:

(a) Use the access card issued to them or the Bluetooth access via the GymMaster App each time they enter the Golf Athletics facility.

(b) Ensure that all surfaces, including equipment and exercise mats, are covered with a clean towel during use and wiped down after each use.

(c) Refrain from using abusive, offensive, obnoxious, or threatening language or behaviour while at the facility.

(d) Always wear clean and appropriate clothing for the Activities being undertaken. Jeans, work clothes, boots, or clothing with offensive or inappropriate images are not permitted.

(e) Avoid training shirtless, ensuring that adequate and appropriate clothing is worn at all times.

(f) Not enter the facility under the influence of drugs or alcohol.

(g) Refrain from smoking, consuming alcohol, using drugs, eating food, or chewing gum while at the facility or in the carpark. Smoking and/or vaping  is permitted on the nature strip outside. Golf Athletics is a strictly no-smoking and no-vaping facility.

(h) Seek instruction from Golf Athletics personnel before using equipment or facilities if they are unfamiliar with its use.

13. Classes and Facility Availability

13.1. Classes

If your Activities include golf or fitness classes, the Member agrees that: (a) Unless directed otherwise, they are required to book their classes in advance via the Golf Athletics App (web portal) or through Golf Athletics personnel.

(b) Missed classes will be forfeited, and Golf Athletics is not obligated to reschedule any missed classes. This includes all adult and junior classes.

13.2 Availability

(a) While Golf Athletics will make every effort to ensure classes and equipment are available during advertised hours, there may be occasions when classes or equipment are fully booked, unavailable, or no longer offered. Golf Athletics is not liable for such occurrences.

(b) Golf Athletics reserves the right to change class schedules and times at its absolute discretion without prior notice.

(c) The Member acknowledges that during public holidays and over the Christmas and New Year breaks, the frequency of classes may be reduced or classes may be unavailable. This has been considered in the Fees, and no fee discounts will be provided for this.
